The traveler, Phil Mocek, has been a regular participant in discussions of ID requirements and TSA procedures on Flyertalk.com, and has been mentioned here before for his efforts to uncover what the &#8220;rules&#8221; if any) are at TSA checkpoints. According to <a href=\"http:\/\/philosecurity.org\/\">initial<\/a> <a href=\"http:\/\/cdc.coop\/tsa_arrest\">reports<\/a> and <a href=\"http:\/\/www.flyertalk.com\/forum\/travel-safety-security\/1017373-flyer-processed-arrested-nm-after-declining-show-id-1.html\">discussion<\/a> elsewhere, he was released Monday, after a night in jail, and charged with criminal trespass (<a href=\"http:\/\/www.amlegal.com\/albuquerque_nm\/\">Albuquerque Code of Ordinances<\/a> <a href=\"http:\/\/www.amlegal.com\/nxt\/gateway.dll\/New%20Mexico\/albuqwin\/chapter12criminalcode?f=templates$fn=document-frame.htm$3.0#JD_12-2-3\">\u00a7 12-2-3<\/a>), resisting, obstructing or refusing to obey a lawful order of an officer (<a href=\"http:\/\/www.amlegal.com\/nxt\/gateway.dll\/New%20Mexico\/albuqwin\/chapter12criminalcode?f=templates$fn=document-frame.htm$3.0#JD_12-2-19\">\u00a7 12-2-19<\/a>), concealing identity with intent to obstruct, intimidate, hinder or interrupt (<a href=\"http:\/\/www.amlegal.com\/nxt\/gateway.dll\/New%20Mexico\/albuqwin\/chapter12criminalcode?f=templates$fn=document-frame.htm$3.0#JD_12-2-16\">\u00a7 12-2-16<\/a>), and disorderly conduct (<a href=\"http:\/\/www.conwaygreene.com\/nmsu\/lpext.dll\/nmsa1978\/9b0\/efc5\/f64b\/f64d?f=templates&amp;fn=document-frame.htm&amp;2.0\">NMSA \u00a7 30-2-1<\/a>).\u00a0[Note: It appears that direct links to sections of the <a href=\"http:\/\/www.amlegal.com\/albuquerque_nm\/\">Albuquerque Code of Ordinances<\/a> will work only after you click on the\u00a0<a href=\"http:\/\/www.amlegal.com\/albuquerque_nm\/\">Albuquerque Code of Ordinances<\/a> link and then on either &#8220;frames&#8221; or &#8220;no frames&#8221;, to set the required cookies in your Web browser.]<\/p>\n<p>As of now, it&#8217;s unclear whether the arrest was primarily in retaliation for Mr Mocek&#8217;s declining to proffer evidence of his identity or his recording of audio, video, and\/or still <a href=\"http:\/\/carlosmiller.com\/2009\/11\/17\/man-arrested-after-refusing-to-show-tsa-his-identification\/\">photographs<\/a>. \u00a0It&#8217;s also unclear whether he was arrested by, or at the behest of, Feds or local or state law enforcement officers (or TSA contractor rent-a-cops?), an issue that has figured prominently and sometimes decisively in other ID-demand and checkpoint cases.<\/p>\n<p>We wish Mr. Mocek success in defending against these bogus charges and obtain obtaining redress from those responsible.
